Sir, can it possible if the company will process it on our behalf since you're requiring us to have one. In some companies, if it is mandatory, the company will process it. In our case, we don't have enough time because of our full time job in the afternoon. Unlike others, they have a lot time to do the transaction since they have a lot of free time in the afternoon. The PM shift teachers have already abided the directive of the upper management. I would also like to know where is it written in the Labor law that companies are OBLIGATED to provide their employees an ATM card. I work part time for an online ESL company and all the employees there secured their own ATM cards. Just saying.....

"you will see from the way the law is written, it looks upon atm payroll as something beneficial to the employee. even if the law did not provide that the employer can unilaterally switch to an atm payroll, this does not mean it was unlawful to do so."

I have also been working in this industry for 9 years now and all of the companies I had worked for and still working for processed the ATM cards for their employees. They just ask for requirements from their employees and the administration has the responsibility to do the transaction at the bank. It should not be mandatory. If an employee can't pass the requirements for some reasons, he/she is not forced to do so. Anyway, it is the employee's right to get the salary in the most convenient way he/she wants to receive it. It is his/her choice and the company should give its employees options. If some employees want their salary thru ATM, that's fine and if the other employees find it more convenient to receive cash as their salary then it should be okay too. Anyway, it's their hard earned money. Where is it written in the LABOR CODE that says employees should be obliged to get an ATM for the salary?

Form. You should, as a rule, pay in cash. Payment by promissory notes, vouchers, coupons, tokens,
tickets, or chits is prohibited. This is illegal even if both the employee and employer agreed. You
may, however, pay by check or money order but you must comply with guidelines prescribed by the
Department of Labor. (See Article 102, LCP; also Sec 2, Rule VIII, Book III, IRR)
Time. Wages should be paid at least once every 2 weeks or twice a month at intervals not
exceeding 16 days. The only exception is when there is force majeure or circumstances beyond the
employer’s control, but he should pay immediately after such force majeure or circumstances have
ceased. (See Article 103, LCP)
Place. As a rule, the employer should pay at or near the place of work, except in cases of
deteriorating peace and order situation and emergencies or calamities which makes payment in the
workplace impossible. But the employer is required to provide transportation and the time for
traveling should be considered as compensable hours worked. (See Article 104, LCP; also Sec 4a,
Rule VIII, Book III, IRR)
Payment may also be made through banks or through an ATM facility, but guidelines provided by
the Department of Labor must be complied with (See Article 104, LCP; also Sec 4, Rule VIII, Book
III and Labor Advisory on Payment of Salaries through ATM)

I would like to give razerly a round of applause for being smart since she knows how to use google very well. Her comment actually exists in google. I have been working in this industry for 5 years now and I am actually the manager of my afternoon job. As far as I remember, I've never encountered this problem. Some ESL companies ask their employees to get ATM card. The employees will pass their requirements and someone from the company will process it. And if some employees can't get their atm, they give their salary in cash or cheque. Since Razerly is very much concern about this matter, I would like to offer a little help for her. My Aunt is Commissioner Lucila Castillo Tarriela. She works for DOLE. Normally, she doesn't talk to just anyone. And since you are my co-worker, I will tell her to give you some time. You can ask her some questions regarding this matter and she will give you precise answers. Oh, by the way, you can search her in google as well.

Hi thanks all for your opinions since I want my company to run in a cooperative way.
After giving it a second thought, I decided to allow some exceptions. So here's some updates.
1) YOU CAN SELECT BETWEEN ATM OR CASH. Please send Aileen your preference within this week. You can even switch to the other method if you want later.
2) The company will ask new employees to submit a bank account for secure salary transaction from now on, like many other call centers.
Just in case if you have an objection or other ideas, please send me a msg privately through this website (or through Aileen). I will carefully review your opinion before actually updating the house rules.
Last thing regarding commenting manners, I strongly advice that you be polite to your co-workers. Next time I see any kind of sarcasm or impolite comment attacking a person, the one will get a written warning from the company for having a harmful effect on company atmosphere.
